These Terms of Service ("Terms") are a binding agreement between you and Vibe Visualizer ("we", "us", "our") governing your use of the Vibe Visualizer application and website (the "Service"). By purchasing, downloading, or using the Service, you agree to these Terms.
1. The license we grant you
Subject to these Terms and a valid purchase, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use Vibe Visualizer on the devices permitted by your license, for your own creative and commercial performances (e.g. live shows, events, installations).
2. What you may not do
You may not: (a) copy, resell, sublicense, rent, or redistribute the app or your license key; (b) share your license key to let unlicensed people use the app; (c) reverse-engineer, decompile, or attempt to defeat the license/activation system except where such restriction is prohibited by law; or (d) use the Service unlawfully or to infringe others' rights.
3. Ownership
The Service, including all software, designs, and content (excluding content you import), is owned by Vibe Visualizer and protected by intellectual-property laws. We reserve all rights not expressly granted to you. You retain all rights to your own media (videos, images, etc.) that you import into the app.
4. Payments, billing & subscriptions (Merchant of Record)
Our order process is conducted by our online reseller Lemon Squeezy. Lemon Squeezy is the Merchant of Record for all our orders. Lemon Squeezy provides order processing, customer service inquiries, and handles returns. For payment, billing, tax, cancellation, and refund mechanics, see Lemon Squeezy's Terms. Monthly subscriptions renew automatically for the same period until cancelled. You can cancel anytime through the link in your purchase email; cancellation stops future renewals and your access continues until the end of the current paid period. Prices may change with notice for future billing periods.
5. Refunds
Refunds are governed by our Refund Policy, which is incorporated into these Terms.
6. Updates
We may provide updates that add, change, or remove features. We aim to keep the app working well but do not guarantee that any particular feature will remain available.
7. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, to the maximum extent permitted by law, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free.
8. Limitation of liability
To the maximum extent permitted by law, Vibe Visualizer will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the 12 months before the claim.
9. Termination
We may suspend or terminate your license if you materially breach these Terms (e.g. license sharing or piracy), for non-payment, or for security/fraud risk. You may stop using the Service at any time by cancelling your monthly subscription.
10. Governing law
These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict-of-laws rules. Disputes will be handled in the courts located there, unless your local law requires otherwise.
